fa خطای پزشکی و رسیدگی به آن در حقوق فرانسه حقوق پزشکی Medical Law سرمقاله Editorial <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:IRANsharp;"><strong>مقدمه:</strong> در حقوق فرانسه رسیدگی به خطای پزشکی تحولات زیادی را طی کرده و امروزه یک نظام کامل جبران خسارت پزشکی در این کشور طراحی شده، به‌صورتی که هم حقوق بیمار و هم نگرانی پزشک از هزینه‌های جبران خسارت را رفع کرده است. برخلاف حقوق سنتی فرانسه و تقسیم‌بندی کلی مسئولیت بر حسب خدمات پزشکی در بیمارستان دولتی یا خصوصی، از سال ۲۰۰۲ با پذیرش هر نوع تقصیر در خصوص دعاوی ناشی از ارایه خدمات پزشکی و درمانی، صرف نظر از عمومی یا خصوصی‌بودن موسسه ارایه‌دهنده خدمات، رژیم حقوقی جدیدی ایجاد شد و با تحول در مفهوم تقصیر زمینه تحول مسئولیت پزشکی در این کشور فراهم آمد. در این تحول، روش‌های جدید و متنوع جبران خسارت در صورت بروز خطای پزشکی از روند دوستانه پیگیری و مصالحه میان طرفین از طریق کمیسیون‌های مصالحه و جبران خسارت حوادث پزشکی شروع و تا پرداخت خسارت توسط صندوق تضمینی اداره ملی جبران خسارات حوادث پزشکی ادامه دارد. همچنین مسئولیت کیفری و انتظامی پزشک در نظام حقوقی فرانسه تقویت شده و حتی برای تصمیمات آخرین مرجع عالی پزشکی یعنی شورای ملی نظام پزشکی نیز نظارت شورای دولتی فرانسه در نظر گرفته شده است.<br> <strong>نتیجه‌گیری:</strong> بررسی حقوق فرانسه در زمینه خطای پزشکی و راهکارهای رسیدگی به آن می‌تواند برای نظام سلامت ایران و بسیاری از کشورها مفید بوده و بسیاری از اشکالات را رفع نماید.</span></span><span style="font-family:IRANSharpSmall Light,sans-serif;"><span style="font-size:10.0pt;"></span></span></div> <span style="font-family:IRANSharpSmall Light,sans-serif;"><span style="font-size:10.0pt;"></span></span> <div style="text-align: justify;"><strong>Introduction:</strong> In French law, medical error proceeding has undergone many developments, and at present in this country a comprehensive medical compensation system is designed to address both patient rights and physician concerns about the costs of compensation. Contrary to traditional French law and the general classification of medical services in a public or private hospital, a new legal regime has been adopted since 2002 by accepting any fault for medical malpractice, regardless of whether the service provider was public or private, and an evolution in the concept of fault for medical liability was created in this country. In this development, new and varied methods of compensation in the event of a medical malpractice start from the friendly process of reconciliation between the parties through the Conciliation and compensation committees for medical accidents and continue until payment is made by the Guarantee Fund of The National Medical Accident Compensation Office.
