fa وضعیت قراردادهای مالی افراد مبتلا به اختلال دوقطبی از دیدگاه حقوق مدنی روان‌پزشکی قانونی Forensic Psychiatry مقاله مروری Review Article <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:yekanYW;">زیربنای اعمال حقوقی اراده اشخاص است و بدون قصد و اراده ماهیت اعتباری به وجود نمی<span dir="LTR">‌</span>آید. اراده، امری درونی و نفسانی است و تا زمانی که ابراز و اظهار نشود، آثار حقوقی نخواهد داشت. شیوع و گسترش بیماری<span dir="LTR">‌</span>های روحی و روانی جدید در افراد موجب شده تا اراده اشخاص مبتلا به اقسام مختلف چنین بیماری<span dir="LTR">‌</span>هایی با شک و تردید همراه باشد. با گسترش اطلاعات و پیشرفت فناوری، دسترسی به بسیاری از موضوعات تخصصی در حوزه<span dir="LTR">‌</span>های مختلف دیگر میسر شده است. به همین سبب، بسیاری از محققان، ازجمله محققان حوزه حقوقی، تمایل بیشتری به تحقیق و پژوهش در حوزه<span dir="LTR">‌</span>های تخصصی دیگر دارند. با بررسی بیماری اختلال دوقطبی و شرایط آن متوجه می<span dir="LTR">‌</span>شویم که بیماران مبتلا به این اختلال از لحاظ ماهیت آنچه که با آن روبه<span dir="LTR">‌</span>رو هستند و شرایط خلقی خود، محجور تلقی می<span dir="LTR">‌</span>شوند. از این رو، معاملات بیماران دوقطبی نوع یک و بیماران دوقطبی با تناوب سریع، باتوجه به شیدایی کامل و جنونی که تجربه می<span dir="LTR">‌</span>کنند، باطل و بی<span dir="LTR">‌</span>اثر است. بیماران اختلال دوقطبی نوع 2 و بیماران اختلال خلق ادواری از لحاظ وضعیت جنون<span dir="LTR">‌</span>آمیز، معاملاتشان باطل نیست اما به دلیل نوسانات خلقی، از اراده لازم برای تشکیل اعمال حقوقی برخوردار نیستند و وضعیت این دسته از بیماران دوقطبی باید در لحظه مورد بررسی قرار بگیرد.</span></span></div> <div style="text-align: justify;"><span style="font-size:14px;">The underlying basis of legal acts is the volition of individuals, and without the intention and will, the nature of credit will not exist. The will is an internal and sensual matter and will not have legal effects until it is expressed and manifested. The spread of new mental illnesses in people has caused the people&rsquo;s will with different types of such illnesses to be questioned. With the spread of information and the advancement of technology, access to many specialized topics in various other fields has become possible. Because of this, many researchers, such as legal scholars, are more inclined to perform research in other specialized fields. Investigating bipolar disorder and its conditions, we find that patients with bipolar disorder are considered isolated in terms of the nature of what they are experiencing and the mood they have. Hence, the kind of type 1 bipolar patients and rapid-cycling bipolar patients are void and ineffective due to the complete mania and insanity they experience.
