fa بررسی شکایات ارجاعی مرتبط با کاربرد لیزر در پزشکی، به کمیسیون پزشکی قانونی استان تهران قصور پزشکی Medical Malpractice مقاله پژوهشی Research Article <div style="text-align: justify;"><span style="font-family:yekanYW;"><span style="font-size:14px;"><strong><span style="color:#0563c1;">مقدمه:</span></strong> قصور پزشکی یک مشکل اساسی در سیستم<span dir="LTR">‌</span>های بهداشتی و درمانی است. امروزه تکنولوژی لیزر عضو جدایی<span dir="LTR">‌</span>ناپذیر در پزشکی است. هدف از مطالعه حاضر شناسایی علل متداول و تصمیمات مربوط به شکایات قصور پزشکی مرتبط به کاربرد لیزر در پزشکی است.<br> <strong><span style="color:#0563c1;">روش بررسی:</span></strong> فراوانی و ماهیت پرونده<span dir="LTR">‌</span>های قضایی آسیب<span dir="LTR">‌</span>های ناشی از کاربرد لیزر در درمان، ارجاع شده به اداره کمیسیون<span dir="LTR">‌</span>های پزشکی قانونی استان تهران در طی سال<span dir="LTR">‌</span>های ۱۳۹۵ تا ۱۳۹۹ مورد بررسی قرار گرفت.<br> <strong><span style="color:#0563c1;">یافته</span></strong><strong><span dir="LTR"><span style="color:#0563c1;">‌</span></span></strong><strong><span style="color:#0563c1;">ها:</span></strong> طی این سال<span dir="LTR">‌</span>ها ۳۱۴ پرونده در این خصوص به اداره کمیسیون پزشکی قانونی استان تهران ارجاع شد. وقوع دعاوی مربوط به کاربرد لیزر در درمان روند رو به رشدی را نشان می<span dir="LTR">‌</span>دهد. پزشکان عمومی و سپس چشم<span dir="LTR">‌</span>پزشکان، بیشترین مورد دعاوی را به خود اختصاص داده بودند. بیشترین علت شکایت از دید شاکیان فقدان مهارت کافی در درمان گزارش شده بود. از ۳۱۴ مورد دعاوی حقوقی مربوط به لیزر، ۲۰۳ مورد (۶/۴۶درصد) منجر به محکومیت پزشکان و تایید قصور پزشکی شد.<br> <strong><span style="color:#0563c1;">نتیجه</span></strong><strong><span dir="LTR"><span style="color:#0563c1;">‌</span></span></strong><strong><span style="color:#0563c1;">گیری: </span></strong>مهم<span dir="LTR">‌</span>ترین عامل در بروز شکایات، فقدان مهارت کافی و استفاده از اپراتورهای آموزش<span dir="LTR">‌</span>ندیده و نبود نظارت بر عملکرد افراد غیرمتخصص در زمینه لیزر در پزشکی است. با بررسی و تجزیه و تحلیل پرونده<span dir="LTR">‌</span>های حقوقی مرتبط با لیزر، می<span dir="LTR">‌</span>توان نقطه ضعف لیزر را در علوم پزشکی پیدا کرد و برای رفع این مشکلات اقدام کرد. در نتیجه می<span dir="LTR">‌</span>توان از آسیب<span dir="LTR">‌</span>های احتمالی جلوگیری کرد و ایمنی بیمار را بهبود بخشید.</span></span><strong><span style="font-family:B Nazanin;"><span style="font-size:10.0pt;"></span></span></strong></div> <div style="text-align: justify;"><span style="font-size:14px;"><strong>Introduction:</strong> Medical malpractice is a major problem in healthcare systems. Nowadays, laser technology is an integral part of medicine. The present study aimed to recognize the common causes and decisions relevant to medical malpractice complaints that are concerned with the use of lasers in medicine.<br> <strong>Methods:</strong> The frequency and nature of judicial cases of injuries induced by the use of laser in treatment, referred to the Office of Forensic Medicine Commissions in Tehran Province over the years 2016 and 2020 were investigated.<br> <strong>Results:</strong> During the years 2016 and 2020, 314 relevant cases were referred to the Tehran Forensic Medicine Commission. The occurrence of lawsuits relevant to utilization of lasers in the treatment indicates a growing trend. General practitioners, followed by ophthalmologists, had the highest cases of complaints. The main reason for the complaints from the complainants&#39; point of view was the lack of sufficient expertise in treatment. Out of 314 laser lawsuits, 203 (64. 6%) resulted in doctors&rsquo; convicting and confirming medical malpractice.<br> <strong>Conclusion:</strong> The most significant factor in the occurrence of complaints is the lack of sufficient expertise and the use of untrained individuals and the lack of monitoring of the performance of non-specialists in the field of lasers in medicine.
