fa بیماری مولتیپل اسکلروزیس (MS) و آموزه‌های پزشکی قانونی جرم و جزا Crime and Penalty گزارش مورد Case Report <div style="text-align: justify;"><span style="font-family:yekanYW;"><span style="font-size:16px;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">مقدمه:</span></b><span lang="FA"> هدف از این مطالعه بررسی چند مورد پرونده قصور پزشکی و تحمل کیفر حبس یا غیر حبس بیماران</span> <span lang="FA">مولتیپل اسکلروزیس (</span><span dir="LTR">MS</span><span lang="FA">) می‌باشد تا با بررسی فرآیندهای قانونی رسیدگی به پرونده‌های قصور پزشکی این دسته از بیماران و ارائه شاخص‌های تعیین تحمل کیفر حبس یا غیر حبس برای آنان&nbsp; منجر به کاهش قصور پزشکی</span> <span lang="FA">&nbsp;در روند تشخیص و درمان و افزایش آگاهی جامعه پزشکی شود.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">گزارش مورد:</span></b><span lang="FA"> در خصوص مسئله قصور پزشکی، پرونده دو خانم بررسی شد که در مورد اول به دلیل عدم استفاده از فرآیند تشخیصی صحیح، قصور پزشکی محرز و در دومی به دلیل استفاده از فرآیند تشخیصی صحیح علی رغم تشخیص نادرست قصور پزشکی محرز نگردید. در خصوص مسئله تحمل کیفر حبس یا غیر حبس نیز پرونده دو بزهکار بررسی شد که پس از ارزیابی شدت بیماری برای مورد اول کیفر حبس قابل‌تحمل و برای مورد دوم کیفر غیر حبس غیر قابل تحمل تشخیص داده شد</span><span dir="LTR">.</span><span lang="FA"><span style="font-family:"B Zar""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">نتیجه‌گیری:</span></b><span lang="FA"> عدم‌تشخیص به‌موقع بیماری MS و متعاقباً اشتباه در طرح درمان، منجر به طرح شکایت علیه پزشک معالج خواهد شد. لذا به‌کارگیری فرآیندهای تشخیصی صحیح و مدیریت عوارض طرح‌های درمان تأکید می گردد. جهت ایجاد یک‌رویه یکسان در صدور نظریه‌های پزشکی قانونی در مورد پرونده تحمل کیفر حبس یا غیر حبس با توجه به وضعیت بیمار، یک سری معیارهای مشخصی ارائه شد.</span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-family:Times New Roman;"><span style="font-size:14px;"><span style="line-height:2;"><b><span style="color:#17365d">Introduction: </span></b>This study aims to assess several medical malpractice cases and the punishment of imprisonment or non-imprisonment of <b>&nbsp;</b><span style="background:white"><span style="color:#222222">Multiple Sclerosis</span></span> (MS) patients, to investigate the legal processes of dealing with medical malpractice cases of this category of patients and provide criteria for determining the tolerance of punishment of imprisonment or non-imprisonment for them which will reduce malpractice in the process of diagnosis and treatment and also increase the awareness of the medical community.<br> <b><span style="color:#17365d">Case Report:</span></b><b> </b>Regarding the issue of medical malpractice, the cases of two women were investigated, in the first case, medical malpractice was proved due to not using the correct diagnostic process, and in the second case, medical malpractice was not&nbsp; proved due to the use of the correct diagnostic process despite the incorrect diagnosis. Regarding the issue of tolerating imprisonment or non-imprisonment punishment, the cases of two criminals were also assessed, and after evaluating the severity of the disease, it was found that the first case which is imprisonment punishment was tolerable and the second case which is non-imprisonment punishment was found to be intolerable.<b><span dir="RTL" lang="FA"><span style="font-family:"B Zar""></span></span></b><br> <b><span style="color:#17365d">Conclusion:</span></b> Failure to diagnose MS disease on time and subsequent mistakes in the treatment plan will lead to filing a complaint against the attending physician, therefore, the use of correct diagnostic processes and management of complications of treatment plans are emphasized.
