fa بررسی چگونگی مستندسازی صحنه قتل عمد در اصفهان An Investigation into Crime Scene Documentation of Murder Cases in Isfahan حقوق پزشکی Medical Law مقاله پژوهشی Research Article زمینه و هدف: فرایند ثبت یا مستندسازی در بررسی صحنه جرم از اهمیت و جایگاه ویژهای برخوردار است. به همین دلیل، نویسندگان در این مقاله به بررسی و بازشناسی این فرایند به‌طور ویژه در مستندسازی صحنه جرم قتل عمد پرداخته اند. روش بررسی: ابتدا شرح مبسوطی از مفاهیم اصلی اطراف این موضوع  مانند صحنه جرم و انواع آن، روش‌های بررسی صحنه جرم، ماهیت مستندسازی و بررسی روش‌ها و اهداف مستندسازی، تیم بررسی صحنه و ارتباط آن با سایر عوامل دخیل در بررسی صحنه جرم مانند بازپرس و پزشک قانونی با استفاده از منابع کتابخانهای تشریح شده و سپس با استفاده از روش مطالعه میدانی و چک لیست تنظیم شده، مستندات تهیه شده از صحنه‌های قتل توسط تیمهای بررسی صحنه جرم استان اصفهان موردبررسی قرارگرفته‌اند. بنابراین، میتوان بیان کرد که این مطالعه از نوع مطالعات میدانی است. یافته ها: فرایندهای بررسی صحنه جرم، به‌خصوص فرایند مستندسازی، که در این مطالعه موردبررسی قرار گرفت، با معیارهای شناخته‌شده این حرفه، فاصله بسیار زیادی دارد؛ زیرا عواملی مانند آموزش ندیدن صحیح کارشناسان صحنه در خصوص نحوه انجام فرایندهای مستندسازی، آگاهی نداشتن کارشناسان صحنه با روشها و تکنیکهای روز مستندسازی، عدم نظارت بر عملکرد این تیمها، عدم آشنایی صحیح با فرمهای بررسی صحنه و عدم دقت و توجه کارشناس به هنگام تکمیل فرم بررسی صحنه وجود دارد. همچنین بین سه سازمان پزشکی قانونی، پلیس و دادگستری تعامل مناسبی در هنگام بررسی صحنه وجود ندارد  و این، به واسطه وجود عواملی مانند نبود احساس وظیفه و  نظارت بر عملکرد این نهادهاست. نتایج: ارائه آموزش کافی و مستمر، نظارت بر مستندات تهیه‌شده، داشتن دقت و توجه در تهیه مستندات (به‌خصوص فرمها)، و درنهایت استفاده از تجهیزات مناسب میتواند منجر به کاهش دستگیری سهوی متهمان، گریختن مجرمان واقعی از چنگال عدالت، و بیاعتمادی مردم به نهادهایی همچون پلیس و قوه قضائیه در استان اصفهان گردد. <div style="text-align: justify;">Background: The process of documentation is an essential activity in crime scene investigation; hence, the researchers in this paper studied the process of documentation, particularly for scenes of murder.  Method: At first, a detailed description through desk review of relevant literature was provided for the main concepts of the issue such as crime scene and its various types, crime scene investigation methods, the nature and purpose of documentation, crime scene investigation team, and its relationship with other contributing factors such as prosecutor and forensic agent. Then, by using the method of field study and a prepared checklist, the documents of murder scenes provided by investigation teams in Isfahan were examined. Results: The results demonstrated that the scene investigation process, particularly documentation process studied in this paper, is far away from the  accepted standards of this field, and the reasons of such a status are poor training on documentation techniques, lack of knowledge and awareness of modern documentation practices, lack of supervision over the activities of documentation team, unfamiliarity with scene investigation forms, and lack of precision in filling the forms. Furthermore, there is a poor coordination among three involved organizations, including forensic Medicine Organization, police, and the judiciary system due to such reasons as poor sense of duty in involved individuals, and failure to supervise the performance of these institutions at the end of any scene investigation.  Conclusion: Providing adequate and continuous training, monitoring the prepared documentation, having attention and focus on the preparation of  documentation (especially forms), and finally the use of appropriate equipment can lead to the reduction in the inadvertent seizure of accused, escape of real criminals from the justice, and People's distrust of institutions like the police and the judiciary in Isfahan province.</div> مستندسازی صحنه جرم, قتل عمد, تیم بررسی صحنه.
