fa بررسی و تعیین شاخص های تشخیص اراده و قوه تمییز در بیماران روانی ارجاعی به بخش روان پزشکی قانونی روان‌پزشکی قانونی Forensic Psychiatry مقاله پژوهشی Research Article <p dir="RTL"><strong>زمینه و هدف:</strong> با توجه به عدم وجود تعاریف دقیق واژه &shy;های اراده و تمییز از دیدگاه حقوق و روان&shy;شناسی و انطباق این تعاریف با اختلالات روانی و هم چنین وجود اختلاف نظر بین کارشناسان جهت تعیین مسئولیت کیفری بیماران روانی براساس ماده 149 قانون مجازات اسلامی لازم شد تا در جهت تعیین شاخص‌های این دو مفهوم این طرح پژوهشی انجام پذیرد.</p> <p dir="RTL"><strong>روش بررسی:</strong> این پژوهش با به کار گیری تکنیک فوکوس گروپ و برگزاری پنج جلسه تخصصی با حضور روان&shy; پزشکان، حقوق&shy; دانان و قضات شعب مختلف برگزار گردید. در هر جلسه متن ماده واحده 149 قانون مجازات اسلامی در اختیار افراد قرار گرفت و از آن&shy;ها خواسته شد دو واژه اراده و قوه&shy; ی تمییز که در متن این ماده واحده به آن اشاره شده است را تعریف کنند.</p> <p dir="RTL"><strong>یافته&shy; ها و نتیجه گیری:</strong> با جمع بندی مطالب مطرح شده توسط قضات؛ روان&shy; پزشکان و حقوق &shy;دانان تعاریفی کاربردی برای دو واژه تمییز و اراده ارایه گردید: اراده &quot;نوعی توانمندی نفسانی توأم با شعور است که به طور مستقیم منشأ بروز رفتار می&shy;شود و در همراهی با صفت قدرت منجر به اختیار و انتخاب آزاد عمل در مقابل اجبار و اضطرار می گردد&quot;. اگر فاعل قدرت نداشته باشد، عملی به وقوع نمی&shy; پیوندد و اگر قدرت داشته باشد و اراده نداشته باشد فعل او اختیاری محسوب نمی&shy; گردد<strong>. </strong>قوه تمییز را نیز می‌توان این گونه توصیف نمود: &quot;توانایی فهم ماهیت افعال و درک و پیش بینی آثار و تبعات آن برای خود و دیگران و قدرت تشخیص مباح از ممنوع&quot;.</p> <p><strong><em>Background:</em></strong><em> Lack of&nbsp;precise&nbsp;definitions for terms such as volition and discernment from that point of view of law and psychology; the need to conform&nbsp;the&nbsp;definitions with&nbsp;mental&nbsp;disorders; disagreement among the experts to determine the penal responsibility of the mental patients according to section 149 of the Islamic&nbsp;penal code of Iran, were the main causes of carrying the present study out.</em></p> <p></p> <p><strong><em>Methods:</em></strong><em> This study used </em><a href="https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=9&cad=rja&uact=8&ved=0CG0QFjAI&url=http%3A%2F%2Fwww.sswm.info%2Fsites%2Fdefault%2Ffiles%2Freference_attachments%2FWBI%2520Evaluation%2520Group%25202007%2520Nominal%2520Group%2520Technique.pdf&ei=AbICVPu5B8XmsAS3i4H4DA&usg=AFQjCNGxEaVNctBoFkHeZ6qE1AX9JQt2vg&sig2=hPmSG6METk2ylFBInCM01w"><em>focus&nbsp;groups technique</em></a><em> in five meetings participated by psychiatrists,&nbsp;lawyers and&nbsp;judges. In each meeting the text of the section 149 of the Islamic&nbsp;penal code of Iran was given to audience and they were asked to define the terms of will and discernment that are mentioned in this section.</em></p> <p></p> <p><strong><em>Findings & Conclusion:</em></strong><em> Applied definitions of volition and discernment are achieved by summarizing the comments presented by judges, psychiatrists and lawyers, including: will &quot;a kind of mental ability coupled with intelligence that is the direct source of behavior and in conjunction with power leads to free choice versus compulsion and coercion &quot;. If the agent does not have the power, the act does not occur and power without will leads to an act that is not regarded as volitional and authority cannot be regarded as action.
