fa بررسی خلاء های قانونی پیوند اعضاء در افراد مبتلا به مرگ مغزی پزشکی قانونی Forensic Medicine مقاله پژوهشی Research Article <strong><span style="font-family:nazanin;"><span style="font-size:10.0pt;">مقدمه و هدف:</span></span></strong> <span style="color:black;"><span style="font-family:nazanin;"><span style="font-size:10.0pt;">یکی از موضوعات نوین و مهم پزشکی در حوزه درمان بیماران، برداشت عضو از افراد مبتلا به مرگ مغزی و پیوند آن به بیماران نیازمند می&shy;باشد. بحث پیوند اعضا برداشت شده از افراد مبتلا به مرگ مغزی به عنوان یکی از مسائل مستحدثه، دارای پتانسیل&shy;های مثبت و منفی بسیار است و بدین جهت لازم است با قانون&shy;گذاری ضابطه مند شود. </span></span></span><span style="font-family:nazanin;"><span style="font-size:10.0pt;">در همین راستا قانون&shy;گذار بر آن شده است تا با تدوین قانونی در این خصوص به بحث پیوند اعضا نظم و نسق ببخشد. قانون پیوند اعضا از افراد فوت شده <span style="color:black;">در مورخ 17</span>/1/1379 به تصویب رسیده است. اگرچه این قانون توانسته است بخشی از ابهامات را در این خصوص مرتفع سازد اما در <span style="color:black;">عمل</span>، نواقص و ابهامات فراوانی در این قانون به چشم می&shy;خورد. هدف <span style="color:black;">پژوهش</span> حاضر بررسی خلاها و نواقص قانون مرتبط با پیوند اعضا جهت توانمند سازی بحث نوظهور پیوند اعضا<span style="color:black;">ی برداشت شده از </span>افراد مبتلا به مرگ مغزی و ارائه برخی <span style="color:black;">پیشنهادات در راستای </span>کاهش مشکلات قانونی پیش رو می&shy;باشد. </span></span><br> <strong><span style="font-family:nazanin;"><span style="font-size:10.0pt;">روش بررسی:</span></span></strong><span style="font-family:nazanin;"><span style="font-size:10.0pt;"> روش کتابخانه ای، توصیفی و در حد لزوم بهره گیری از نظرات متخصصین و مصاحبه با کارشناسان و متخصصین امر می&shy;باشدکه سعی می&shy;شود ضمن توصیف و شناخت نسبی آن&shy;ها به بررسی، نقد و تحلیل مباحث مربوطه پرداخته شود.</span></span><br> <strong><span style="font-family:nazanin;"><span style="font-size:10.0pt;">نتایج:</span></span></strong><span style="font-family:nazanin;"><span style="font-size:10.0pt;"> قانون پیوند اعضا به مبحث وصیت شخص بر <span style="color:black;">اهدای عضو،</span> رضایت اولیای وی براین امر واحراز مسلم بودن مرگ مغزی پرداخته است. فی نفسه اگر چه قانون مصوب تا حدی راه&shy;گشا بوده است ولی موارد<span style="color:black;">ی </span>ازچشم قانون&shy;گذار به دور مانده است که این نقیصه&shy;ها می&shy;تواند مشکلات عدیده ای را در راه اجرای این قانون به وجود آورد. از جمله این نواقص&nbsp; <span style="color:black;">می&shy;توان به </span>بحث عدم شناسایی کارت اهدای عضو به عنوان رضایت فرد بر اهدا، عدم تعیین زمان دقیق فوت در فرد مبتلا به مرگ مغزی<span style="color:red;">،</span> <span style="color:black;">عدم تعیین تکلیف در مورد </span>عدم اعلام رضایت اولیای فرد و یا افراد مجهول الهویه ی مبتلا <span style="color:black;">به مرگ مغزی اشاره نمود</span>. <span style="color:black;">اگرچه بازنگری، اصلاح نواقص موجود و تکمیل قانون موثرترین و مهم&shy;ترین </span>راه حل می&shy;باشد، ولیکن می&shy;توان، اخذ مجوز از نماینده ولی فقیه رابه عنوان راه حلی فوری در نظر گرفت. (در خصوص افراد ناشناس مبتلا به مرگ مغزی؟آیا این امر در سایر موارد نیز کاربرد دارد)</span></span><br> &nbsp; <strong><em>Background:</em></strong><em> One of the new and important medical issues in treatment of patients is harvesting organs from brain-dead patients to be transplanted into patients in need. The issue of transplanting organs harvested from brain-dead patients is one of the emerging issues, with many positive and negative potential consequences and therefore it should be regulated by legislation. In this respect, the legislator has decided to regulate the issue of organ transplantation by providing a legal act that was ratified in 2001. Although the legislation could eliminate some ambiguities in this regard, but in practice, there are still some weaknesses and ambiguities in the law. This article examines the gaps and shortcomings of that law regarding organ transplants taken from brain dead patients and provides suggestions in order to reduce legal problems of the emerging efforts in this relatively new field of medicine.</em><br> <strong><em>Methods:</em></strong><em> Literature review, descriptive methods and, when necessary, expert opinions, mainly collected through interviews with experts of the field, were used to explain and analyze the relevant issues.</em><br> <strong><em>Results:</em></strong><em> The organ transplantation law deals with issues such as a person&#39;s will to donate organs, consent of the donor&#39;s relatives for donating the organs and ascertainment regarding occurrence of brain death.
